Terms and conditions and the way of operating the website

1. These terms and conditions determine the terms of advertising on the zonaumeni.cz portal and the way the website is operated (hereinafter referred to as the terms and conditions).

2. The website „Zóna umění“ mainly collects information about art competitions, art shows, art courses, art seminars, art workshops, art camps and art lecturers.

3. The operator of the portal zonaumeni.cz is MgA Vladimír Halíček, Helfertova 539/44, 61300 Brno (hereinafter referred to as „the operator").

The content of the zonaumeni.cz website is to a large extent created or co-created by their subscribers (customers), who are allowed by the operator to store information on the website. In relation to these customers and the content they enter, the operator is in the position of a service provider, which consists in storing the content of the information provided by the customer (the operator is therefore a so-called hosting provider). In accordance with § 5 et seq. of Act No. 480/2004 Coll. , on certain information society services and on the amendment of certain laws, the operator is not responsible for the content of information stored at the customer's request and is not obliged to supervise the content of transmitted or stored information or to actively search for facts and circumstances pointing to illegal information content.

4. These terms and conditions and the way of operating the website (hereinafter referred to as the terms and conditions) are effective and valid from 01.08.2023.

5. Part of the terms and conditions are the operator's price lists and technical specifications of the advertisement, available on the zonaumeni.cz portal, unless the agreement between the parties states otherwise.

6. These terms and conditions are accessible on zonaumeni.cz.

7. Advertising means a text of a person different from the operator, which is not the operator's own text, posted on the zonaumeni.cz portal, whether for financial consideration, other payment or free of charge.

8. The customer means any person who orders the dissemination of advertising.

9. The customer is entitled to open a client account (hereinafter referred to as "client administration") for the purpose of ordering and paying for advertising on the zonaumeni.cz website.

10. When creating an account, the customer confirms that they have familiarized themselves with these terms and conditions, price lists and technical specifications, agree with them and undertake to comply with them. Without this consent, the customer cannot create a client account.

11. The customer enters his order through the client administration. The customer fills in his personal or company data and the data they want to advertise.Then they ask the operator to approve the advertised content - the order. If the operator approves the order - the advertised content, it will send the order approval notification and documents for payment of the advertisement to the customer electronically. After paying the prescribed amount, the operator will publish the advertisement.

12. The advertising contract is concluded upon confirmation of the order by the operator.

13. The content of the advertisement must respect the principles of good morals and must not violate laws or other binding regulations applicable in the Czech Republic.

14. The customer is responsible for the content of the advertisement and undertakes that the advertisement and the materials for the advertisement submitted to the operator will not be in conflict with legal regulations, good morals and the rules of economic competition and that the dissemination of such advertisement will not unjustifiably affect the rights and legitimate interests of third parties and will not violate generally binding legal regulations and that all financial claims arising from copyrighted works or likenesses of natural persons used in the advertisement have been satisfied by the customer on the day of ordering the advertisement. The customer declares that the photos submitted for advertising were taken with the consent of the persons depicted and that these persons agree to the publication of the photo for the purpose of advertising. The customer undertakes to compensate the operator for damage or loss incurred to the operator as a result of the publication of the advertisement, including the costs of legal proceedings and the costs of legal representation.

15. The operator will publish the advertisement at times and in places according to the operator's possibilities.

The customer agrees to comply with all instructions and all policies defined on zonaumeni.cz.

16. In case of repeated or serious violations, the operator may temporarily suspend or permanently deactivate the relevant accounts.

17. The customer or third parties may notify the operator of content that appears to be in violation of this content policy at any time.

18. The operator always issues a tax receipt to the customer after payment of the advertising price, that is, after the payment has been credited to the operator's account.

19. Each party is entitled to terminate the advertising contract by written notice delivered to the other party. The notice shall be effective upon delivery to the other party. Advertising that is being circulated at the time of termination of the contract will be terminated in the deadlines set by the operator.

20. The operator is responsible for advertising defects in case of incorrect, illegible or incomplete dissemination of the advertisement, only if the purpose of the advertisement was affected by such defect and the contract was violated in a substantial way. The customer is obliged to notify the operator of the defect in writing within five (5) days from the first publication of the advertisement. In case of a justified complaint, the operator will provide, based on his options, a discount on the price of the advertisement or the free distribution of a replacement advertisement.

21. Due to serious operational reasons or reasons of force majeure, the operator reserves the right not to meet the agreed deadline or placement of the advertisement. If the parties do not agree otherwise, in such case the provider is entitled to ensure the distribution of advertising in the nearest possible time and approximate the place.

22. The operator reserves the right to limit or terminate a user's access to the portal zonaumeni.cz at any time.

23. The operator is not responsible for any unauthorized interference with the portal zonaumeni.cz, unauthorized access to the operator's data, or any other unauthorized interference with the operator's computer systems. The operator is not responsible for damages caused by temporary interruption or limitation of access to the portal zonaumeni.cz.

24. The operator is entitled to unilaterally change these terms and conditions and price lists to a reasonable extent at any time. The change in terms and conditions is effective on the day of their publication on the zonaumeni.cz portal, unless a different effective date is set by the operator.

25. The customer is entitled, within thirty (30) days from the publication of the updated version of the terms and conditions and price lists, to notify the operator by e-mail of his disagreement with the updated version of the terms and conditions and price lists and to terminate the contract with a five-day notice period, which begins on the day of verifiable delivery of the notice to the operator, otherwise the updated terms and conditions become binding for the contractual relationship and the dissemination of advertising from the specified effective date.

26. The website zonaumeni.cz may contain links to external websites, the content and operation of which the operator has no influence on, does not guarantee their content, accuracy, and takes no responsibility for them. If website refers to other subjects, then the operator of these sites is responsible for the content, the operator of www.zonaumeni.cz is not responsible for this content.

27. The operator may place the advertiser's activities on Zona umeni Facebook page without his consent.

II. Personal data protection and consent to personal data processing

1.1 The operator is the administrator of personal data to the extent that such data is provided by the customer as part of the order for services provided by the operator and/or as part of the performance of the contract concluded between the customer and the operator. As part of filling out the order, this includes information about name, e-mail and telephone number.

1.2 Personal data is all information that can be directly or indirectly (i.e. together with other data) related to a living natural person. These data include, for example, names, IP addresses, behavioral patterns and contact details such as telephone number, email address and postal address.

1.3 The operator determines the purposes and means of processing personal data provided by the customer.

1.4 The processing of personal data includes any operation performed on personal data, such as collection, recording, adaptation, modification, use, storage, disclosure, blocking or destruction.

1.5 The data we process about the customer will be stored for as long as the customer is interested in the products and services of the operator and then for additional 3 years. In case the customer concludes a contract with the operator, their data will be processed by the operator for at least 3 years after the service provision ends. After that, personal data will be deleted.

1.6 Personal data is processed for the purpose of communication with the customer and for the fulfillment of the contract. Furthermore, the operator processes personal data for marketing purposes, so that he can offer the customer his products and services via email based on his legitimate interest.

1.7 The operator may disclose personal data to public authorities in cases stipulated by law, in case of criminal investigations, or if he is otherwise obliged to publish such data by law or on the basis of a decision of a public authority.

1.8 In accordance with valid data protection laws, the data subject has the right to request access to the processed personal data at any time. He also has the right to correct inaccurate personal data, the right to demand that the operator stops processing and deletes the customer's personal data, so that the operator limits the processing of the customer's personal data, the right to exercise his right to data portability and file an objection to the processing of personal data, including an objection to profiling.

1.9 If the customer wishes to exercise any of their rights or ask questions regarding the processing of their personal data by the operator, they can contact the operator at the email address info@zonaumeni.cz, on the website www.zonaumeni.cz or at the address Helfertova 539/44, 61300 Brno.

1.10 The customer also has the right to file a complaint with the relevant supervisory authority at any time if they believe that their personal data is being processed in violation of applicable data protection laws.

1.11 The operator has implemented technical and organizational security measures necessary to protect personal data from unauthorized access, use, alteration, or deletion.

III. Information about cookies

Cookies are small text files that are created when a website is displayed. They are used as a tool to store information about how our pages are utilized.
